Togut, Segal & Segal publishes article in the ABI Journal on decisions impacting a debtor’s ability to pay creditors’ fees and expenses

In the March 2021 edition of the American Bankruptcy Institute Law Journal, partner Frank A. Oswald, and associate John C. Gallego discuss recent rulings from the Mallinckrodt chapter 11 cases regarding a debtor’s ability to pay the fees and expenses of parties to a restructuring support agreement.  Such issue is often a key component of facilitating negotiations with stakeholders in an effort to obtain a confirmable and consensual plan of reorganization.
