Togut, Segal & Segal LLP Retained as Counsel to Roger Frankel as Future Claimants’ Representative in Cyprus Mines Corporation Chapter 11 Case

Pursuant to an order of the United States Bankruptcy Court for the District of Delaware entered on August 9, 2021, the Togut Firm is representing Roger Frankel as the legal representative for all persons who may assert personal injury claims arising from exposure to talc that was mined, processed, and/ or distributed by Cyprus Mines Corporation or a former subsidiary, in connection with Cyprus Mines’ chapter 11 case, styled as In re Cyprus Mines Corporation, Case No. 21-10389 (LSS) (Bankr. D. Del.). As of January 29, 2021, Cyprus Mines had been sued by approximately 427 personal injury claimants.

Mr. Frankel was appointed as Future Claims’ Representative by the Bankruptcy Court over the objections of a number of insurance companies which had proposed their own slate of highly qualified individuals to serve as the representative.

Under the chapter 11 plan proposed by Cyprus Mines, talc-related personal injury claims against Cyprus Mines and another chapter 11 debtor, Imerys, are to be channeled to a trust for the benefit of creditors, including the possibility of a combined trust as part of a comprehensive global settlement between Cyprus Mines and Imerys. The Togut Firm is assessing this proposed structure with the Future Claimants’ Representative.

The Togut Firm is working alongside Delaware counsel, Burr & Forman LLP and Frankel Wyron LLP in connection with representing Mr. Frankel in this case.
